ON THE 2 ND OF September around 500 women and their supporters gathered at Holyrood to protest against proposed changes to the Gender Recognition Act. This has become one of the most divisive issues in Scottish politics, but why?
The legislation on gender recognition was originally introduced as a way to allow people of the same sex to marry. Introducing the ‘legal fiction’ that it is possible to change sex was seen as more politically acceptable in 2004 than to allow same-sex marriage. Those who drafted the legislation argued that it was to assist around 5,000 people who would be granted a Gender Recognition Certificate (GRC) – the mechanism by which a change of legal sex can occur. Their estimate has proved remarkably accurate with around 300 applications being made per year for the 10 years to 2014 rising to around 350 a year thereafter.
