GitHub’s Copilot has been producing AI-powered code for well over a year now and it’s certainly clever, but it has also raised concerns. One of these is over open source licensing. This issue has been given new impetus – and one Matthew Butterick has decided to take the legal route. Butterick has been professionally involved with open source software since 1998. He also happens to be a lawyer. Back in the summer, he wrote an article highlighting the legal problems around GitHub Copilot with the catchy title of ‘This Copilot is Stupid and Wants to Kill Me’. Now he, and others, are investigating a potential lawsuit against Copilot for violating its legal duties to open source authors.
