My Voxi SIMs have expired – can I get a refund?
Q Last summer, I purchased 20 ‘mobile data only’ Voxi SIM cards (pictured below) from an eBay seller. These worked well. I had some cards left over that I wanted to use this year, but they didn’t work. Vodafone (which owns Voxi) says its terms make it clear that SIMs are disabled if they’re not activated within the first six months. But I wasn’t told about this by the eBay seller and I’m now out of pocket by £107. How can I get my money back?
Alan Wood
A Alan should contact the eBay seller and explain the situation. He should point out that the listing had a misleading omission because it didn’t state the time limit on activating the cards.
Had he bought the cards after 6 April 2025 he would have used the new Digital Markets, Competition and Consumers Act (DMCCA) to seek a refund. But this law doesn’t apply retrospectively, so instead he should cite the Unfair Trading Regulations. His rights are the same regardless. Details of when SIM cards must be activated by clearly count as vital information that can influence whether a customer makes the purchase, so withholding this is misleading. It’s possible the eBay seller didn’t know about the activation deadline, but that’s no excuse.
